TERMS OF SERVICE
Terms of Service – MakeMuse
Effective Date: July 1, 2026
Welcome to MakeMuse. These Terms of Service (“Terms”) govern your use of www.makeandmuse.com (the “Website”) and your purchase of products from MakeMuse. By browsing the Website, creating an account, or placing an order, you agree to be bound by these Terms and all policies referenced herein. Nothing in these Terms overrides mandatory consumer rights that cannot be excluded by law.
1. About These Terms
The Website is operated under the MakeMuse brand by Xie’ou Zhonggou (Shanghai) Trading Co., Ltd. (“we”, “us”, or “MakeMuse”). These Terms apply to all visits, accounts, purchases, and other interactions with the Website. Our Shipping Policy, Returns Policy, Privacy Policy, and any other published policies are incorporated into these Terms by reference.
2. Eligibility
You must have the legal capacity to enter into a binding contract. If you are a minor (under the age of 18, or such other age as defined by applicable law), you may only use the Website under the supervision and with the consent of a parent or legal guardian. You are responsible for complying with all applicable laws and regulations in your jurisdiction.
3. Customer Accounts
If you create an account, you agree to:
-
Provide accurate, complete, and up‑to‑date registration information;
-
Maintain and promptly update your information;
-
Keep your login credentials confidential;
-
Notify us immediately of any suspected unauthorised access or activity.
You are responsible for all activities that occur through your account, except to the extent caused by our failure to implement reasonable security measures.
4. Product Information
We strive to present accurate descriptions, images, dimensions, materials, prices, options, and care instructions. However, due to:
-
Screen settings and photography variations;
-
Lighting and environmental factors;
-
Handmade craftsmanship and natural material variations;
-
Reasonable manufacturing tolerances;
actual colours, textures, dimensions, or appearance may differ slightly from what is shown. Please review the product description and selected options carefully before ordering.
5. DIY and Handmade Products
DIY products may require assembly, crafting, painting, or other customer involvement. You agree to:
-
Follow the provided instructions;
-
Use appropriate tools and protective equipment;
-
Exercise adult supervision where applicable.
Handmade items may naturally evolve over time depending on materials, usage, and care. Unless expressly labelled as suitable for children, handmade products are not toys and should be kept out of reach of young children.
6. Personalised and Made‑to‑Order Products
For personalised items (e.g., engraving, naming, image selection, colour adjustment), you are solely responsible for checking all text, images, colours, dimensions, and options before submitting your order.
Personalised and made‑to‑order products typically require additional production time. Unless they arrive damaged, defective, materially incorrect, or not matching your confirmed customisation, they are not eligible for change‑of‑mind returns. If such a product is faulty, we will provide an appropriate remedy (repair, replacement, or refund) in accordance with applicable law.
7. Prices and Payment
All prices are displayed in the currency shown on the Website or at checkout. Shipping charges, taxes, customs fees, and other applicable charges collected by us will be itemised before you complete payment.
By submitting an order, you authorise us and our payment service providers to charge the total amount to your selected payment method. We accept payment methods as indicated at checkout.
8. Orders and Contract Formation
Your submission of an order constitutes an offer to purchase the products in that order. We reserve the right to reject or cancel any order for legitimate reasons, including but not limited to:
-
Product unavailability;
-
Pricing or listing errors;
-
Suspected fraud or unauthorised transaction;
-
Payment failure or verification issues;
-
Delivery address restrictions;
-
Violation of these Terms.
Contract formation: A binding contract between you and MakeMuse is formed when we:
-
Send you an order confirmation email (subject to our acceptance), or
-
Dispatch the products (if we choose to accept by performance).
If we cancel an order after payment has been collected, we will issue a full refund to the original payment method.
9. Order Changes and Cancellations
If you need to change or cancel your order, please contact us as soon as possible at service@makeandmuse.com. We will attempt to accommodate your request, but once processing, production, or dispatch has begun, we cannot guarantee that any change or cancellation can be completed.
10. Shipping and Delivery
Shipping destinations, rates, processing times, and estimated transit times are set out in our Shipping Policy. Estimated delivery dates are not guarantees – actual delivery may be delayed due to:
-
Customs clearance;
-
Severe weather or natural disasters;
-
Carrier disruptions;
-
Incorrect or incomplete address provided by you;
-
Public holidays;
-
Other circumstances beyond our reasonable control.
You are responsible for providing an accurate and complete delivery address. Risk of loss and title pass to you upon delivery to the carrier, except where local law provides otherwise.
11. Customs Duties and Import Taxes
International orders may be subject to customs duties, import taxes, brokerage fees, or other charges imposed by the destination country. Unless we expressly state otherwise at checkout, these charges are your sole responsibility. We cannot declare an order as a “gift” or understate its value.
12. Returns and Refunds
Returns, exchanges, replacements, and refunds are governed by our Returns, Refunds and Cancellation Policy. Nothing in these Terms excludes any rights or remedies that you may have under applicable consumer protection laws.
13. Promotions and Discounts
Promotional offers, discount codes, free gifts, and limited‑time deals may have additional terms and conditions. Unless otherwise stated:
-
Promotions cannot be combined with other offers;
-
They are not exchangeable for cash;
-
They cannot be applied to previous purchases.
We reserve the right to withdraw or modify any promotion at any time, with notice where required.

17. Third‑Party Services and Links
The Website may use or contain links to third‑party services (e.g., payment gateways, shipping carriers, social media platforms). Those services are governed by their own terms and privacy policies. We are not responsible for the content, practices, or availability of any third‑party website or service beyond our control.
18. Errors and Availability
We reserve the right to correct any typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, availability, or other information, at any time without prior notice.
If an error affects your order, we will contact you and offer options, which may include correcting the error, cancelling the order, and issuing a full refund.
19. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from events beyond our reasonable control, including but not limited to: acts of God, war, terrorism, strikes, governmental actions, epidemics, natural disasters, carrier failures, or disruptions in internet or power supply. We will make reasonable efforts to resume performance as soon as practicable.
20. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Website and all content and services are provided on an “as‑is” and “as‑available” basis. We do not warrant that the Website will be uninterrupted, error‑free, or free of harmful components.
This disclaimer does not exclude or limit any warranties, guarantees, or consumer rights that cannot be lawfully excluded under the laws of your jurisdiction.
21. Limitation of Liability
To the fullest extent permitted by law, Xie’ou Zhonggou (Shanghai) Trading Co., Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Website or products purchased, including but not limited to loss of profits, data, or goodwill.
Nothing in these Terms limits our liability for:
-
Fraud or fraudulent misrepresentation;
-
Death or personal injury caused by our negligence;
-
Any other liability that cannot be limited or excluded by mandatory law.
In any event, our total aggregate liability to you in respect of any single order shall not exceed the total amount paid by you for that order.
22. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless MakeMuse and its affiliates, officers, employees, and agents from and against any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:
-
Your unlawful use of the Website;
-
Your breach of these Terms;
-
Your infringement of any third‑party rights.
23. Termination
We may suspend or terminate your access to the Website or your account without liability if we reasonably believe that you have:
-
Engaged in fraud, unlawful conduct, or security breaches;
-
Materially breached these Terms;
-
Posed a risk to us or other users.
Upon termination, you must cease using the Website. Provisions that by their nature should survive termination (e.g., intellectual property, limitation of liability, indemnification, governing law) will remain in effect.
24. Governing Law and Dispute Resolution
These Terms and all transactions are governed by the laws of the People’s Republic of China, without regard to conflict‑of‑law principles, except where mandatory consumer laws of your country of residence provide otherwise.
Any dispute arising out of or in connection with these Terms shall first be resolved through friendly negotiation. If negotiation fails, the dispute shall be submitted to the Shanghai International Economic and Trade Arbitration Commission (SHIAC) for arbitration in accordance with its rules, or alternatively, you may bring a claim before a competent court in Shanghai, China, as permitted by law. This arbitration provision does not deprive you of your statutory right to seek remedies in your local courts if mandatory consumer laws so require.
25. Waiver and Severability
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
26. Entire Agreement
These Terms, together with all policies referenced herein (including the Privacy Policy, Shipping Policy, and Returns Policy), constitute the entire agreement between you and MakeMuse regarding your use of the Website and purchase of products, superseding any prior agreements or communications.

By using the Website, you consent to our collection and use of your information in accordance with that policy. You have the right to access, correct, or request deletion of your personal data at any time by contacting us.
29. Changes to These Terms
We may revise these Terms from time to time to reflect changes in our services, business practices, or legal obligations. The revised version will be posted on this page with an updated effective date.
If a material change is made, we will provide additional notice (e.g., via email or website banner).
